Thomas Beatie, the transman who made headlines after becoming pregnant in 2008, is trying to divorce his wife but is being blocked by a state judge who questions the legality of the union.
Beatie has been attempting to divorce his wife since May. Initially, his lawyer David Michael Cantor was thrilled that Beatie’s marriage was being upheld as a valid marriage under Arizona state law, but now a judge is saying that because both Beatie and his wife have female sex organs, their union is illegal.
Arizona has not adopted marriage equality yet.
The judge, like most of the world, is aware of the three children Beatie bore when married to his wife. The judge says he cannot find any legal authority that defines a man as someone who is able to give birth.
Beatie has a US passport and Hawaiian birth certificate that both list him as male.
In May, Beatie was granted temporary full custody of the couple’s children after wife Nancy was caught on video attacking her husband in a violent manner and trashing their computer.

ummmm He is a man…I am confused by your statement “We’re she a man she’d have fathered a child. Women give birth.” I would beg to differ with you….I know plenty of cis women who cannot give birth and plenty of cis men that can not have children…You are obviously confused!! Please do not define someone else just because you feel that being different is wrong. It does not make it harder …what makes it harder is for people who want to call someone other than their PREFERED GENDER PRONOUN!!!!…..Get a clue!! before you hurt yourself!
